Amendment 6: Right to speedy and public trial, impartial jury and right to counsel
In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the Assistance of Counsel for his defence.
The right to a trial is very important to our sense of right and wrong. The truth of the matter is that you are either guilt or not, but as our government is set up you have the right to a fair trial with a jury a decision makers. They hear the trial and make their decision as they come to a consensus with everything presented but it your right to take part in this process. This leaves citizens with protection against unjust accusations and lets their peers judge accordingly. We have been following this process diligently and it has resulted in many changes and has also brought to light where some of our laws fall short.
This video dives into the jury of peers selected for the trial to which we are given. The selection definitely something worth questioning because they are the ones deciding the outcome of the trial. He argues that is is somewhat impossible to get a general reflection of the population in a jury. This may lead to people who are guilty end up getting out of being persecuted. This does make you question the legitimacy, but ultimately still puts the power in hands of the people.
This Constitutional discussion goes over this amendment and solidifies the purpose of each section. Back upon English rule persons were held indefinitely without access to a trial, which is what we were trying to avoid. Each person should have access to a trial, before a judge and peers, within a timely manner of being held in custody or whatever the situation may be. We protect ourselves from a government in power holding it's citizens unjustly. The speedy portion of it guarantees that this will happen in a timely manner as to determine a decision, else the person must be let go.
